Ethics Brown Bag - M. Sokolowski: Substitute Decision-Making or Best Interests Standard - Is one more "morally superior" than the other?  When an "incompetent" patient's previous capable wishes are unknown, by law we are obliged to assume a Substitute-Decision-Making Standard. If that is not possible, the law dictates we move to a Best Interests Standard. From a moral point of view, is one superior to the other?
